NeuroBlossom App™ Terms of Use

Agreement to These Terms

By selecting “Agree and Continue,” you confirm that you have read and agree to these Terms of Use. If you do not agree, do not select “Agree and Continue” or use the NeuroBlossom™ app.

Age and Eligibility

You must be at least 16 years old to use the app. If you have not reached the age of legal majority where you live, you may use the app only with the permission of a parent or legal guardian and as permitted by applicable law. You must have the legal capacity to agree to these Terms or use the app with any authorization required by applicable law.

App Store Terms

If you downloaded the app through Apple’s App Store, your use of the app is also subject to Apple’s applicable terms, including the Apple Standard Licensed Application End User License Agreement. These Terms supplement those terms. If a provision of these Terms conflicts with an applicable App Store term, the App Store term will control to the extent of that conflict.

Purpose of the App

NeuroBlossom provides educational information, self-reflection tools, reminders, and nervous system regulation exercises. The app is intended to support personal awareness and self-care. It does not provide medical, psychological, psychiatric, or other professional health care services.

Not Medical Advice or Treatment

Information and exercises presented in the app are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease, injury, or health condition. Use of the app does not create a doctor-patient, therapist-client, or other professional relationship with Breakthroughs NOW LLC or any contributor to the app.

Pain and Other Symptoms

Pain and other symptoms can have multiple contributing factors. The app may help you explore whether stress physiology is contributing to what you are experiencing, but it cannot determine the cause of a symptom. Do not use the app as a substitute for medical evaluation or treatment. Please seek appropriate health care when needed.

Emergencies

The NeuroBlossom app is not designed or intended for medical or mental health emergencies and does not monitor users or contact emergency services. If you believe you or another person may be in immediate danger or may be experiencing an emergency, stop using the app and contact local emergency services or an appropriate crisis service immediately.

Your Use of the App

You are responsible for deciding whether and how to use the app. Stop an exercise if you feel unsafe, significantly worse, or unable to continue comfortably. Seek qualified professional assistance when appropriate. Do not use the app in a manner that is unlawful, unsafe, disruptive, or likely to interfere with another person’s use of the app.

No Guaranteed Results

Responses to self-regulation exercises vary. Breakthroughs NOW LLC does not promise or guarantee that Emotional Handwashing, Heart-Core Centering, reminders, check-ins, or any other app feature will reduce pain, distress, or other symptoms or produce any particular result. A rating that remains unchanged or increases does not establish whether an exercise was effective or whether a health condition is present.

Ratings, Notes, and Reminders

Ratings and notes entered in the app are subjective self-reports intended for personal use. They are not clinical measurements, diagnoses, or substitutes for records maintained by a qualified health care professional. App reminders are provided for convenience only. Their delivery and display may depend on your device, operating system, notification permissions, and settings. Do not rely on the app to deliver urgent, medically necessary, or time-sensitive reminders.

User-Directed Sharing

The app may allow you to download, export, or share certain content or information. You are responsible for reviewing what you choose to share and selecting the recipient, destination, or third-party service. Once you share content, Breakthroughs NOW LLC cannot control how it is used, retained, copied, or redistributed. Do not share information unless you are comfortable disclosing it.

Privacy

Your use of the app is also subject to the NeuroBlossom App Privacy Policy. Please review that policy for information about how app data is handled.

Third-Party Resources

The NeuroBlossom app may include links to third-party websites, directories, educational materials, or other resources for informational convenience. These resources are operated independently of NeuroBlossom Media. The inclusion of a third-party resource does not imply that NeuroBlossom Media is affiliated with, sponsored by, endorsed by, or otherwise formally associated with the organization, practitioner, or service identified in that resource, unless expressly stated otherwise. NeuroBlossom Media does not control third-party websites or resources and is not responsible for their availability, accuracy, content, privacy practices, services, or outcomes. Any decision to contact, engage, or receive services from a third-party practitioner or organization is made independently by the user. Users should evaluate the qualifications, suitability, and terms of any third-party provider before obtaining services.

Intellectual Property and Trademarks

NeuroBlossom™ and associated NeuroBlossom branding are trademarks of Breakthroughs NOW LLC. The app’s original software, text, graphics, design, arrangement, and other original materials are owned by or licensed to Breakthroughs NOW LLC and are protected by applicable intellectual property laws. Third-party names, trademarks, service marks, logos, and other proprietary identifiers that may appear in the app or in connection with external resources are the property of their respective owners. Their appearance in the app is for identification or informational purposes and does not imply affiliation with, sponsorship by, or endorsement of NeuroBlossom Media or Breakthroughs NOW LLC unless expressly stated otherwise.

Availability and Changes

The app and its features may be changed, updated, interrupted, or discontinued. Breakthroughs NOW LLC does not guarantee that the app will always be available, error-free, or compatible with every device or operating-system version.

Disclaimer of Warranties

To the fullest extent permitted by law, the app is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Breakthroughs NOW LLC and its owners, officers, employees, contractors, licensors, and contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the app. To the fullest extent permitted by law, the total liability of Breakthroughs NOW LLC arising from or relating to the app or these Terms will not exceed the amount you paid for the app during the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.

Termination

Your right to use the app terminates if you materially violate these Terms. Provisions that by their nature should remain in effect after termination, including provisions concerning intellectual property, disclaimers, limitations of liability, and governing law, will survive termination.

Changes to These Terms

These Terms may be updated as the app develops or legal requirements change. The effective date above will be revised when updated Terms are published. When required by law or when a change is material, we will provide notice and request your acceptance of the updated Terms. Continued use of the app after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

Informal Dispute Resolution

Before filing a legal proceeding, you agree to contact legal@neuroblossommedia.com and provide a reasonable opportunity to resolve the dispute informally, except where immediate relief is necessary or applicable law provides otherwise.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise. Subject to consumer rights that cannot legally be waived, any legal proceeding arising from these Terms or the app must be brought in a state or federal court located in Contra Costa County, California, and each party consents to the jurisdiction of those courts.

General Terms

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver of the right to enforce it later. You may not assign your rights or obligations under these Terms without the prior written consent of Breakthroughs NOW LLC. Breakthroughs NOW LLC may assign these Terms in connection with a merger, acquisition, reorganization, or transfer of the app or related business. These Terms, together with the applicable App Store terms and the NeuroBlossom App Privacy Policy, constitute the entire agreement between you and Breakthroughs NOW LLC concerning your use of the app. Section headings are provided for convenience and do not affect interpretation.
